Service Terms
Terms of Order Android-Development, Publishing, Updates and Support Krepel Studio. The specific agreed scope of work specifies the composition of the selected service.
Project Scope and order confirmation
Before payment, the client receives the final Project Scope, which records:
- selected service;
- what will be created or changed;
- basic functionality;
- key screens and integrations;
- what is included in the work;
- what is excluded;
- deliverables;
- deadlines;
- revision rules;
- warranty / support;
- final price;
- materials, access and credentials to be provided by the customer.
The client confirms Project Scope in writing.
Once Project Scope is confirmed, it is considered the agreed basis of the order. Further changes are governed by the rules of the purchased service.
Payment
- all Krepel Studio services require 100% advance payment;
- payment is made in USDT;
- before payment Krepel Studio informs the exact amount, specific network and wallet address;
- the customer is obliged to check the network and the address before sending;
- blockchain / network fee is paid by the client;
- after sending, the client must send a screenshot of the payment, which shows the amount and the transfer to the provided Krepel Studio wallet address;
- a payment screenshot is required, but payment is received only when the full agreed amount of USDT has actually arrived in Krepel Studio’s wallet;
- if the client independently sent the funds in the wrong network, to the wrong address or the wrong amount, such an operation is not considered a received payment, if the funds have not actually arrived Krepel Studio;
- Krepel Studio is not responsible for funds lost due to incorrect address or network selected by the customer contrary to the provided details;
- if a refund is made according to the agreed rules, it is performed in USDT, and the actual blockchain / network fees are not compensated;
- changing the market price USDT after payment does not change the already agreed amount of the order;
- work begins only after the Official Project Start conditions are met.
Cancellation and refunds
Before Official Project Start
The customer can cancel the order.
Krepel Studio returns the payment received, but does not compensate the paid blockchain / network fees / commissions related to the payment and return.
After Official Project Start
If the client simply changed his mind, changed his priorities or no longer wants to continue the project, there is no refund.
If Krepel Studio cannot perform the agreed Project Scope due to its own fault, the payment for the unperformed service / unperformed part of the agreed obligation is returned to the client.
For Full Google Play Publication, there is a separately agreed guarantee of refunding the cost of the publication service itself, if the production publication did not take place for reasons for which Krepel Studio is responsible.
For Full Google Play Publication, the guarantee covers 100% of the cost of the publication service itself, if the production publication did not take place for reasons on the Krepel Studio side. The completed and transferred development remains a separate service.
Official communication
The main channel is Telegram
Telegram is the main working channel of communication between the client and Krepel Studio.
Through Telegram are conducted:
- clarification;
- approval of decisions;
- Project Scope;
- confirmation;
- current communication;
- progress reports;
- issues during development, publication, update or App Care.
The written agreements in Telegram are used as a working record of the agreements between the parties.
The backup channel is email
Email is an additional / backup channel:
- if Telegram is temporarily unavailable;
- for duplicating important materials;
- for documents or messages that are more appropriate to send by post.
Email is not the main channel of daily communication, as Krepel Studio uses Telegram for constant communication.
Official Project Start
Official Project Start occurs after the fulfillment of all mandatory prerequisites of a specific order, in particular:
- Project Scope confirmed;
- 100% payment received;
- the client has transferred the necessary materials;
- the necessary access/credentials are provided;
- other agreed prerequisites for a specific service are met.
It is from Official Project Start that the terms of performance of the corresponding service are calculated.
Krepel Studio separately confirms Official Project Start in Telegram or email with a specific date after the agreed scope of work, actual receipt of full payment, materials and access. For services with Google Play, the client's account must be ready and verified. App Care has a separately confirmed App Care Start Date.
External delays of Google / third-party services
For the 30-Day Launch Guarantee, the clock pauses for the actual period when an external platform or service makes further necessary work by Krepel Studio objectively impossible.
Such cases may include an abnormally long Google Play review, unavailability of Google Play / Play Console, an additional Google check through no fault of Krepel Studio or unavailability of a critically needed third-party service.
After resuming the ability to continue work, the countdown is resumed, and the actual period of external blocking is added to the deadline.
If the delay is caused by an error Krepel Studio in implementation, declarations or submission, the countdown is not suspended.
Complete App Launch includes 30-Day Launch Guarantee: production-publication within 30 calendar days of separately confirmed Official Project Start under agreed terms. Automatic fines or fixed compensations for exceeding the deadline are not established.
Delays on the part of the client
If Krepel Studio expects a response, approval, materials, access, credentials or other necessary action from the client to continue work, the execution period is automatically suspended.
The countdown resumes after receiving everything necessary, and the actual period of the client's delay is added to the due date.
If a client delay causes Krepel Studio to lose the reserved working slot, the studio may resume work in the next available slot.
Such delay shall not be considered a breach of time or warranty by Krepel Studio.
A hard fixed threshold like 7 or 14 days is not set for this rule.
Amendments and changes to the agreed scope of work
The agreed Project Scope (scope of work) does not change automatically during the execution of the project.
During the work, the client can propose changes, new wishes or changes to the already agreed solution - this is a normal part of the work.
Each such change is separately agreed to by Krepel Studio. The studio determines whether:
- the change is included in the edits provided by the package;
- it can be performed without changing the price and term;
- it needs a change of term;
- it requires additional payment;
- the change is so significant that it actually constitutes a separate new job or new product.
A request sent by the client to Telegram or another channel does not automatically become part of the agreed scope of work. A change is considered accepted only after explicit confirmation by Krepel Studio and the customer.
If Krepel Studio has incorrectly implemented an already agreed function or requirement, its correction is not considered a customer correction and is performed without additional payment.
Android App Development typically takes 7–14 calendar days from Official Project Start. It includes up to two visual direction revision rounds and one final round of minor changes within the agreed scope. The standard bug warranty lasts 14 days from final handoff.
One-Time Update
One-Time Update — $399 covers one complete update cycle for one existing app created by Krepel Studio.
Prior to payment, Krepel Studio will agree with the customer on the specific change list for this update.
One update cycle can include several changes at the same time, in particular:
- bug fixes;
- UI/UX changes;
- full or partial visual refresh;
- processing of individual or all screens;
- text and localization changes;
- adaptation to Android or requirements of Google Play;
- changes to existing functions;
- refactoring;
- optimization;
- adding major new features if Krepel Studio has confirmed that they are included in a specific One-Time Update.
Once agreed, the change list becomes the agreed scope of the particular update.
The client can propose additional changes already during operation, but they are not added automatically. If they significantly exceed the agreed upon upgrade, Krepel Studio will separately identify whether it is new One-Time Update, additional paid work, or new Android App Development.
The fixed price of $399 is applied only after Krepel Studio has confirmed before payment that the customer's request is suitable for One-Time Update.
The number of individual small tasks in itself does not determine the limit of the service. The main criterion is whether the work remains a single agreed update of the same application.
If the request actually turns the app into another standalone product, that's a new Android App Development, not One-Time Update.
Upon completion, the client receives:
- updated source project;
- new AAB;
- new APK.
Posting an update to Google Play is not included automatically and is agreed to separately.
6-Month / 12-Month App Care
The same scope of service applies to 6-Month App Care and 12-Month App Care; only the term of service differs.
The customer can submit an unlimited number of change requests during the paid period App Care.
An unlimited number of requests does not mean unlimited parallel work. Requests are executed sequentially by priority within the working queue Krepel Studio.
The client can change the priorities of requests during work.
App Care covers a maximum of 2 specific Android applications that are fixed at the start of the service period.
These 1–2 active apps may receive major changes, including complete redesigns, changes to screens, features, architecture and localization, optimization, major new features and substantial changes to the supported app’s concept.
App Care does not include the creation of a third standalone application or an unlimited number of new parallel products.
Rights to the product, reusable code and portfolio
After full payment and final transfer, the client gets the right to use the specific application created for him, publish it, monetize it, change it himself or through other developers and continue development without Krepel Studio.
The customer also receives unique materials created especially for his product, including individual design, texts and other assets, if they were part of the order.
Krepel Studio reserves the rights to its universal Android templates, reusable components, typical technical modules, general algorithms, architectural solutions, internal tools, work methods and other developments that were not created exclusively for one specific client.
If such a universal component is included in the source code of the client application, the client can use it within its product, but does not get the exclusive right to prohibit Krepel Studio the use of the same or similar universal component in other projects.
Krepel Studio shall not sell, publish or transfer to another customer the same specific client application as a finished product.
At the same time, a general idea or product category does not become exclusive to one customer. Krepel Studio may create other applications with a similar general idea, as long as they are not copies of a specific customer product.
Third-party open-source libraries, SDK and other third-party components do not become the property of the client or Krepel Studio and are used in accordance with the terms of their licenses.
After the public launch of the application, Krepel Studio has the right to display the application name, icon, screenshots, Google Play link and a brief description of the completed work in his portfolio.
If the client and Krepel Studio agree in writing to confidentiality or a ban on public display before work begins, those materials will not be used in the portfolio.
Signing, credentials and third-party accounts
A separate keystore / upload key is created for the new application. Production AAB/APK are signed with the corresponding key.
After the final transfer, the client receives the keystore, alias, password and other necessary signing data. Secret signing data is transferred separately from the main archive.
After the transfer, the responsibility for safe storage of signing keys passes to the client. The client's loss of the transferred key after handoff is not the responsibility of Krepel Studio.
To update an already existing application, valid signing data of the client is used, if it is necessary for the release.
If the work requires access to Google Play Console, Firebase, Google Cloud, AdMob, API platforms or other third-party services, the client provides Krepel Studio only the level of access necessary to perform the agreed work.
Krepel Studio does not require a password from the client's personal Google account, if the necessary access can be provided by regular means of the corresponding service.
After completing the work, the client can revoke the granted accesses.
Google Play Developer Account, AdMob, Firebase, Google Cloud and other third-party accounts remain the property and control of the client. Krepel Studio does not become the owner of these accounts and does not guarantee the uninterrupted operation of the third-party platforms themselves.
After service completion, Krepel Studio does not retain sensitive credentials longer than is objectively necessary to perform the job, unless otherwise separately agreed to by active App Care or other ongoing support.
The client is responsible for:
- the correctness and relevance of the provided accesses;
- secure storage of transferred signing keys and credentials;
- own third-party accounts;
- payment for third-party services, unless otherwise directly included in the package;
- actions that the customer or other persons authorized by him perform in these accounts after the transfer.
External costs
The price of the service Krepel Studio covers the work of the studio, but does not automatically include the costs of third-party services, unless otherwise expressly stated in a specific package or agreed scope of work.
External costs may include, in particular:
- Google Play Developer registration fee;
- paid API;
- cloud / hosting;
- domains;
- paid tariffs Firebase / Google Cloud;
- Maps, SMS, email services;
- AI API;
- paid SDK;
- license assets;
- other external platforms or services.
Krepel Studio does not make new third-party paid purchases on behalf of the customer without prior approval. If there is a need for a new paid service during operation, the customer is notified of its cost or payment model before connection.
If possible, third-party services are issued directly to the client's account, so that after the completion of the project, they remain under his full control.
If the third-party service required for the work has not been paid for by the client and because of this the continuation of the work is objectively impossible, the execution period is suspended until this blocking is removed.
Exception for Google Play testing
For Full Google Play Publication and Complete App Launch costs for third-party testing service are included in the package within the agreed reserve up to 1000 UAH per application.
Google Play Developer Account, registration fee, paid API and other permanent third-party services are not included in this exception, unless separately agreed to in writing.
Responsibility for the client's materials
The Client may transmit Krepel Studio texts, logos, icons, images, photographs, videos, audio, brand names, fonts, databases, API keys and other materials necessary to perform the agreed work.
Customer acknowledges that it has the right to use and transfer Krepel Studio such materials to work on its product.
Krepel Studio does not conduct a separate legal review of copyright, trademark or other rights for each material provided by the client.
Krepel Studio is not responsible for infringement of third party rights if the problem is caused by materials provided by the customer.
Krepel Studio has the right to refuse to use the material if it is clearly illegal, prohibited or poses a material risk to Google Play or another platform, and may ask the customer to provide a substitute.
If the client's materials cause Google Play to reject the application or require replacement of such materials, this is not considered an error Krepel Studio. The studio can help correct the situation within the scope of the purchased service, but the responsibility for the original material remains with the client.
The client is also responsible for the accuracy of the texts, data, legal names, contact information and other factual information provided by him.
If Krepel Studio expects the client to replace or clarify such material and cannot continue work without it, the performance period is suspended according to the agreed rules of delays on the part of the client.
No guarantee of business results
Krepel Studio guarantees the performance of the agreed technical work within the purchased service, but does not guarantee the specific business result of the application.
Krepel Studio does not guarantee:
- a specific number of downloads or active users;
- sales, revenue or profit;
- specific income from AdMob or Billing;
- application rating;
- positions in Google Play;
- organic traffic;
- getting into recommendations or other promotional blocks Google Play;
- a specific result from advertising, marketing or monetization;
- the overall commercial success of the product.
Decisions Google Play regarding ranking, visibility, recommendations, organic traffic and other algorithmic mechanisms are not controlled by Krepel Studio.
If the application is technically performed in accordance with the agreed scope of work, poor or no business performance in itself is not grounds for a refund, free full rework or other compensation.
The priority of the conditions of a specific order
Before payment, the client receives current Service Terms and a specific agreed scope of work for his order.
The customer confirms the order in writing. After such confirmation and payment, the customer is deemed to have accepted the agreed terms of the specific order.
If the general Service Terms and the specific written scope of work conflict with each other, the specifically agreed scope of work and the individually agreed terms of this order shall take precedence for this order.
Updating Service Terms on the site after Official Project Start does not retroactively change the conditions of an already active order.
For an active order, the conditions agreed upon at the time of its start apply, unless Krepel Studio and the client have separately agreed to their change in writing.
Unlimited requests, queue and end of support period
For 30-Day Extended Launch Support, 6-Month App Care and 12-Month App Care, the customer can send an unlimited number of requests during the active period of the corresponding service.
Requests are carried out sequentially in the agreed priority within Krepel Studio’s working queue. Unlimited requests do not mean unlimited simultaneous work.
A backlog of requests does not automatically extend the 30 days, 6 months or 12 months of service.
Tasks accepted into active work before the service end date are completed.
New or not yet active requests after the expiration date are fulfilled through a new App Care, One-Time Update or other agreed service.
A genuine bug reported during the active warranty or support period is corrected under the applicable warranty, even if the technical fix is completed after the final calendar day of that period.
Complete App Launch includes 30-Day Extended Launch Support: 30 days from actual production release instead of the basic 14 day warranty, with unlimited consecutive requests within the same product.
App Care: term, maintenance cycles and Google Play support
For 6-Month App Care and 12-Month App Care the separately confirmed App Care Start Date is used. It is from this date that 6 or 12 months of service are counted, respectively.
App Care covers up to 2 specific apps created by Krepel Studio, fixed at the start of the period.
For each supported application, Krepel Studio performs a minimum of 1 maintenance cycle every month.
If the 1 application is supported:
- 6 months = minimum 6 maintenance cycles;
- 12 months = minimum 12 maintenance cycles.
If 2 applications are supported:
- 6 months = minimum 12 maintenance cycles in general;
- 12 months = minimum 24 maintenance cycles in total.
Google Play publication of support and maintenance updates is included in App Care. When needed, Krepel Studio prepares the release, updates related declarations, Data Safety and Play Console settings, uploads the AAB and handles review during the active App Care period.
A customer delay may suspend a specific task or maintenance activity, but does not automatically extend the paid 6- or 12-month term App Care.
Time unused because of client inactivity or delays does not accumulate as a time bank and is not automatically carried over beyond the paid App Care period.
If a specific maintenance cycle is objectively impossible to perform due to a client-side blocker, Krepel Studio captures this blocker and performs the appropriate work after its elimination, if App Care is still active at that time.
After app transfer and future platform changes
Krepel Studio is responsible for ensuring that the application meets the agreed scope of work at the time of final handover.
During the valid warranty period, Krepel Studio fixes bugs caused by our implementation of the agreed functionality free of charge.
After warranty or support ends, future changes to Android, Google Play, API, SDK, Billing, AdMob, third-party services or platform requirements do not create an indefinite obligation for Krepel Studio to maintain the app free of charge.
Such future changes, if they require work, are performed through One-Time Update, App Care or other separately agreed upon service.
If the source code is changed by the customer or a third-party developer after the final transfer and it is these changes that cause the problem, Krepel Studio is not responsible for such problem.
If third-party code changes are not related to a specific bug and the corresponding warranty period is still active, the Krepel Studio warranty for this bug is preserved.
Krepel Studio does not guarantee that a transferred version of the application without future updates will remain indefinitely compatible with all future versions of Android, Google Play requirements or third-party services.
The right to suspend or terminate a risky / prohibited project
Krepel Studio does not perform illegal, fraudulent, malicious or explicitly prohibited functionality and is not obliged to implement the circumvention of the rules of Google Play, security systems, verification or other platforms.
If after Official Project Start it turns out that the customer has hidden important information or the actual purpose of the product is significantly different from the agreed, Krepel Studio has the right to suspend the work.
In such a situation, Krepel Studio may offer the client to change the functionality, materials or other elements of the project so that the work can be continued within acceptable limits.
If the client refuses the necessary changes or it is objectively impossible to make the project acceptable, Krepel Studio has the right to stop the execution of the problematic part or the entire order.
Krepel Studio is not obliged to fulfill the client's request just because it was sent after payment, if such a request is illegal, dangerous, prohibited by the rules of the platform or goes beyond the agreed technical scope.
If the blocking or termination of operation is due to hidden, false or materially incomplete information of the customer, this is not considered a default on the part of Krepel Studio.
For such cases, one automatic refund / no-refund formula is not established for all situations. Financial settlement is determined taking into account the actually completed and uncompleted part of the work, the agreed terms of the specific order and the applicable legislation.
Limitation of liability Krepel Studio
To the extent permitted by applicable law, Krepel Studio's maximum aggregate financial liability for a particular order does not exceed the amount actually paid by the customer for the applicable service.
To the extent permitted by applicable law, Krepel Studio shall not be liable for indirect or consequential damages, including:
- lost profit;
- lost income;
- lost business;
- reputational losses;
- loss of commercial opportunities;
- consequences of decisions by Google Play or third-party platforms over which Krepel Studio has no control.
After the final transfer, the client is responsible for the backup and safe storage of the received source project, signing keys, credentials and other transferred materials.
Krepel Studio does not guarantee the absolute absence of any future vulnerabilities, failures of Android, Google Play or third-party services.
This section does not cancel Krepel Studio’s expressly agreed guarantees, including the 14-day bug warranty, Full Google Play Publication guarantee, 30-Day Extended Launch Support or other guarantees included in the purchased service.
Force majeure and events beyond the control of the parties
If the performance of the agreed work is temporarily objectively impossible due to events beyond the reasonable control of the parties, the relevant deadlines are suspended for the actual period of such blocking.
Such events may include, in particular:
- war or hostilities;
- large-scale power outages;
- long-term unavailability of the Internet or critical infrastructure;
- natural disasters;
- actions of state bodies;
- large-scale failures of Google, hosting, cloud providers or other critical platforms;
- other extraordinary circumstances beyond the reasonable control of the parties.
The term is extended for the actual period during which such an event actually blocked the execution of the corresponding part of the work.
If part of the work can be continued, Krepel Studio continues the execution of the part that is not blocked.
Such an event in itself is not considered a breach of terms or warranties by Krepel Studio.
Mandatory client rights under applicable law
All Krepel Studio cancellation, refund, warranty, liability and other terms apply to the extent permitted by applicable law.
If applicable law provides the customer with a mandatory right of withdrawal, refund, compensation or other remedy that cannot be waived by contract, such right shall take precedence over the relevant provision of Service Terms.
The Krepel Studio no refunds rule after Official Project Start in the event the customer simply changes their mind applies to the extent permitted by applicable law.
If the customer's separate express consent is required to begin the service before the expiration of the statutory cooling-off period, Krepel Studio shall obtain such consent prior to the commencement of the relevant work.
The specific scope of the client's mandatory rights depends on the applicable legislation, the client's country and the legal status of the parties.
